By using our website or making a purchase, you agree to these Terms and the policies referenced in them. If you do not agree, please do not use the Services.
Nothing in these Terms limits any rights granted to you under Québec’s Consumer Protection Act or other applicable legislation.
1. Website use
You agree to use our website lawfully and not to:
-
Interfere with the operation or security of the website;
-
Attempt to access an account, system, or data without authorization;
-
Introduce viruses, malware, or other harmful code;
-
Use robots or automated systems to extract content without authorization;
-
Impersonate another person or provide misleading information;
-
Use the website in a way that infringes the rights of Bonbon Bar or another party;
-
Engage in fraudulent or unlawful activity.
You must have the legal capacity required to make a purchase. If you have not reached the age required to enter into a contract independently in your jurisdiction, a parent or guardian must make or authorize the purchase.
2. Customer accounts
Certain features may allow you to create a customer account.
You are responsible for:
-
Providing accurate and current information;
-
Keeping your login credentials confidential;
-
Activities carried out through your account;
-
Promptly notifying us if you suspect unauthorized use.
We may suspend an account when we have reasonable grounds to suspect fraud, abuse, a security threat, or a violation of these Terms.
3. Products and information
We make reasonable efforts to display accurate descriptions, images, ingredients, sizes, availability, and other product information.
The actual appearance of a product may differ slightly from its images because of packaging, manufacturer changes, its handmade nature, or your screen settings.
Manufacturers may change their products, packaging, ingredients, or information without notice. Always review the label and packaging you receive before consuming or using a product.
If information displayed on the website differs from the product packaging, contact us before consuming the product.
We may correct typographical errors or update website information. We will handle any order already concluded in accordance with applicable law.
4. Allergies and dietary requirements
Products may contain or have come into contact with allergens, including peanuts, tree nuts, milk, soy, wheat, gluten, eggs, or sesame.
Ingredient and allergen information is generally supplied by manufacturers. We cannot guarantee that a product or our facilities are free from a particular allergen unless expressly stated.
If you have a severe allergy, intolerance, or particular dietary requirement:
-
Carefully review the product label;
-
Do not rely solely on website images or descriptions;
-
Contact us before purchasing if you are uncertain;
-
Do not consume a product if its packaging or label creates uncertainty.
This information does not replace advice from a healthcare professional and does not limit Bonbon Bar’s legal obligations.
5. Prices and taxes
Unless otherwise stated:
-
Prices are displayed in Canadian dollars;
-
Taxes and shipping charges are added at checkout;
-
Online and in-store prices may differ;
-
Promotions are available during the stated period and subject to their conditions.
Your order total, including applicable taxes and charges, is displayed before confirmation.
We may change prices for future purchases. A later change will not affect the price of an order already concluded, subject to applicable law.
6. Orders and payment
Before confirming an order, you are responsible for reviewing the products, quantities, prices, and delivery information.
By placing an order, you confirm that:
-
The information you provide is accurate and complete;
-
You are authorized to use the selected payment method;
-
You agree to pay the displayed total, including applicable taxes and charges.
Payments are processed through Shopify and external payment providers. A payment provider may decline an authorization.
Before a sale is concluded, we may decline a transaction for a legitimate reason, including suspected fraud, unauthorized payment use, or a legal restriction. Once a contract has been concluded, we will fulfil our obligations in accordance with applicable law.
7. Availability and quantities
Products are offered subject to availability. We may establish reasonable quantity limits before purchase to support fair access to products or prevent unauthorized resale.
If an availability problem arises after an order has been concluded, we will contact you to provide a solution in accordance with the law.
8. Shipping, returns, and refunds
Shipping, delivery, returns, exchanges, and refunds are governed by:
-
Our Shipping and Delivery Policy;
-
Our Return and Refund Policy.
Those policies form part of these Terms. If any provision conflicts with mandatory legislation, the applicable legislation prevails.
9. Gift cards, promotions, and discount codes
Gift cards and promotional codes must be used in accordance with the conditions displayed when they are issued.
Unless otherwise stated:
-
Promotional codes cannot be combined;
-
They cannot be applied retroactively;
-
They have no cash value;
-
They cannot be reproduced, resold, or used fraudulently.
Gift cards cannot be exchanged for cash unless required by law. They do not expire, in accordance with applicable Québec law.
Promotions, contests, and special offers may be subject to additional rules.
10. Purchases for personal use
Our products are primarily sold for personal use or as gifts.
You may not purchase products for commercial resale without our written authorization. We may impose reasonable limits before purchase when an order appears intended for unauthorized resale.
For corporate or bulk orders, contact bonjour@bonbon-bar.com.
11. Intellectual property
The website and its content, including text, photographs, illustrations, logos, trademarks, graphics, videos, layouts, and software, belong to Bonbon Bar or are used with permission from their owners.
You may view the website and retain a reasonable copy of information relating to your order for personal use.
Without prior written permission, you may not:
-
Reproduce, republish, or distribute a substantial portion of the content;
-
Modify or commercially exploit the content;
-
Use our trademarks, logos, or images misleadingly;
-
Suggest an association or endorsement that does not exist.
12. User-submitted content
If you voluntarily submit a review, photograph, suggestion, or other content, you confirm:
-
You have the right to submit it;
-
It is accurate based on your experience;
-
It does not infringe another person’s rights;
-
It is not unlawful, misleading, threatening, or defamatory.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content to operate, promote, and improve Bonbon Bar and its Services.
This licence does not transfer ownership of your content. If the content includes personal information, its use remains subject to our Privacy Policy and applicable consent requirements.
We may decline or remove content that violates these Terms, subject to applicable law.
13. Third-party links and services
The website may contain third-party links or integrations, including services provided by Shopify, payment providers, carriers, and social-media platforms.
Those services are governed by their own terms and policies. Bonbon Bar is not responsible for their content or practices except where the law provides otherwise.
A link to an external website does not necessarily constitute a recommendation or endorsement.
14. Website availability
We make reasonable efforts to keep the website available and secure, but we do not guarantee uninterrupted or error-free operation.
We may temporarily suspend features to perform maintenance, address a security issue, or comply with a legal obligation.
We are not responsible for interruptions reasonably outside our control, subject to liabilities that cannot legally be excluded.
15. Legal warranties
Products sold to consumers are covered by the warranties provided under applicable law.
In Québec, these warranties generally require that a product:
-
Be fit for its normal intended purpose;
-
Last for a reasonable period, considering its price and conditions of use;
-
Be free of hidden defects;
-
Conform to its description and representations made about it.
Nothing in these Terms excludes or restricts those warranties.
16. Limitation of liability
To the fullest extent permitted by law, Bonbon Bar is not responsible for indirect or unforeseeable losses resulting solely from the use of, or inability to use, the website.
This limitation does not apply to:
-
Legal warranties;
-
Bodily injury or property damage;
-
Intentional or gross fault;
-
Obligations under consumer-protection legislation;
-
Any other liability that cannot legally be excluded or limited.
17. User responsibility
You are responsible for reasonably foreseeable consequences of your unlawful website use, fraud, or violation of another person’s rights.
Nothing in this section requires you to indemnify Bonbon Bar for its own fault or limits your rights as a consumer.
18. Suspension or termination of access
We may suspend or restrict access to the website or an account when reasonably necessary to:
-
Protect the security of the website or its users;
-
Investigate fraud or unauthorized activity;
-
Comply with a legal obligation;
-
Stop a material violation of these Terms.
Suspending an account does not alter the rights or obligations associated with an order already concluded.
19. Governing law
These Terms are governed by the laws applicable in Québec and the federal laws of Canada applicable there.
Any dispute will be brought before a court with jurisdiction under applicable legal rules. Nothing in these Terms restricts a consumer’s right to apply to a competent court in their place of residence when permitted by law.
20. Language
French and English versions of these Terms are provided for ease of reference.
The French version is made available to you first. If there is a discrepancy, the French version prevails to the extent permitted by law.
21. Changes to these Terms
We may update these Terms for future purchases and future website use to reflect changes to our Services or applicable laws.
The revised version will be posted with a new date. Changes will not apply retroactively to an order already concluded unless permitted or required by law.
22. General provisions
If a provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A delay in exercising a right does not waive that right.
These Terms, together with the referenced policies and the information supplied during checkout, constitute the agreement applicable to your use of the Services and purchases.
